Services

Zyphin provides marketing and advertising services, which may include but are not limited to: ad strategy, ad creative production, funnel and landing page builds, copywriting, campaign management, tracking/reporting setup, and related consulting. The specific scope, deliverables, timeline, and fees for any engagement will be outlined in a separate proposal, service agreement, or invoice ("Service Agreement"), which forms part of these Terms.

No Guarantee of Results

While we apply industry best practices, data-driven strategies, and our professional expertise to every campaign, Zyphin does not guarantee specific results, including but not limited to lead volume, sales, return on ad spend (ROAS), click-through rates, conversion rates, or revenue.

Marketing and advertising outcomes depend on numerous factors outside our control, including but not limited to:

Any performance projections, estimates, or benchmarks shared verbally, in proposals, or in reports are illustrative only and do not constitute a promise or warranty of future outcomes. Past performance on other campaigns or for other clients is not indicative of future results.

Client Responsibilities

To enable us to deliver our services effectively, the client agrees to:

→ Provide timely access to relevant accounts (e.g., Meta Business Manager, ad accounts, website/CMS access) as required

Delays in providing access, feedback, or approvals may impact campaign timelines and results, and Zyphin is not responsible for delays or underperformance caused by such client-side delays.

Fees and Payment

Intellectual Property

→ Upon full payment, the client will own the final creative assets, copy, and deliverables created specifically for their campaigns, unless otherwise specified in the Service Agreement.

Confidentiality

Both parties agree to keep confidential any non-public business, financial, or strategic information shared during the course of the engagement, and to use such information solely for the purpose of fulfilling the services under these Terms.

Limitation of Liability

To the maximum extent permitted by law, Zyphin's total liability for any claim arising out of or related to our services shall not exceed the total fees paid by the client to Zyphin in the three (3) months preceding the claim. Zyphin shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, revenue, or business opportunities.

Third-Party Platforms

Our services may involve the use of third-party advertising platforms (such as Meta/Facebook, Google, or others). Zyphin is not responsible for outages, policy changes, account suspensions, or other actions taken by these third-party platforms that are outside our control.
